CONSTITUTION OF
KAUWAHI ‘ANAINA HAWAI’I
HAWAIIAN CIVIC CLUB
ARTICLE I
Name, state of charter, principal office
Section 1. The Name of this organization shall be the Kauwahi ‘Anaina Hawaiʻi Hawaiian Civic Club (herein referred to as KAHHCC). The KAHHCC is attached to and under the umbrella of both the Mainland District Council (herein referred to as MCHCC) and the Association of Hawaiian Civic Clubs (herein known as AOHCC).
Section 2. The KAHHCC is registered by the state of Utah as a non-profit corporation and shall operate in conformity with its Constitution and By-laws.
Section 3. The KAHHCC principal office shall be in Utah County in the State of Utah.
ARTICLE II
Purposes and objectives
Section 1. The purpose of this organization is to actively promote and perpetuate long-held traditional Native Hawaiian attitudes and values.
Section 2. The objectives of this organization are:
A. To unite the members in the bonds of friendship and mutual understanding, and create, foster, and maintain the “Spirit of Aloha”.
B. To insure the preservation and perpetuation of the Hawaiian culture (the ancient historical data, traditions, mele and ‘oli of Hawai’i and the learning and use of the Hawaiian language).
C. To promote an active interest in the civic, economic, social, health and moral welfare of our community, particularly with reference to the people of Hawaiian ancestry, to support programs of benefit to them and to the community at large.
D. To encourage the practice of native Hawaiian values in business, industry, and the professional fields.
E. To actively encourage and assist in furthering the education of members of the KAHHCC to improve the quality of life and prospect for a more secure future of the Hawaiian community.
F. To offer the opportunity for scholarships to those with qualifications as approved by the Board.
ARTICLE III
Tax exempt status
Section 1. The KAHHCC is organized under the Utah Non-profit Corporations and Cooperative Associations Act, (Title 16, Chapter 6, Utah Code Ann. 1953) of the State of Utah.
Section 2. The income or net earnings of the KAHHCC shall not serve the private interest or private benefit of any member or individual.
Section 3. The KAHHCC is not organized for profit and no part of the assets, income or earnings shall be used as dividends or other withdrawals, or distributed to any of its members or officers, except for services rendered and previously approved by the Board pursuant to section 501 (c)(3).
ARTICLE IV
Prohibitions
Section 1. The KAHHCC shall not endorse, financially support, or recommend any candidate for political or public office.
Section 2. No officer or member shall use the KAHHCC as a means of furthering the personal or political aspirations of any person.
ARTICLE V
Membership
Section 1. Membership in the KAHHCC shall include anyone who is interested in furthering and perpetuating the Hawaiian Culture.
There shall be two (2) categories of membership:
A. Ohana (Family) membership includes a husband, a wife and dependent children under the age of 18.
B. Ho’okahi (Single) membership includes any single individual.
Section 2. A member is a person who has paid their annual dues.
ARTICLE VI
Organization
Section 1. The KAHHCC shall be governed by a Board of Directors.
A. The Board of Directors shall consist of the officers and up to 4 more directors.
B. The officers of this organization shall consist of: The Pelekikena (President), Hope Pelekikena ‘Ekahi (1st Vice President), Hope Pelekikena ‘Elua (2nd Vice President), Kakau ‘olelo (Secretary), Pu’uku (Treasurer).
ARTICLE VII
Voting
Section 1. All members of the KAHHCC, who are 18 years or older, shall have full voting privileges.
ARTICLE VIII
Fees, dues, assessments
Section 1. The annual dues shall be $40.00 (forty dollars) per family.
Section 2. The annual dues shall be $20.00 (twenty dollars) per single person.
Section 3. Annual dues shall be paid on a calendar year basis. The calendar year shall run from January 1st to December 31st . Dues will not be prorated regardless of the time of year dues are paid. Dues paid in the last quarter of the year (October, November, December) will be applied to the following year.
Section 4. The Board of Directors shall make an evaluation to ensure that the amount of dues set is sufficient to meet the requirements of the KAHHCC. Any increase to the amount recommended by the Board and approved by the membership will apply to the succeeding calendar year.
Section 5. Per capita and dues payments shall be made annually to the AOHCC and the MCHCC.
ARTICLE IX
Amendments
Section 1. This Constitution may be amended by a two-thirds affirmative vote of the members present at any general meeting or virtually when a virtual meeting is set up.
Section 2. All proposed amendments must be circulated to the members no less than 30 (thirty) days prior to the meeting date.
